1. Acceptance of Terms

By downloading, installing, or using newppearance ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and newppearance ("we", "our", or "us").

2. Eligibility

You must be at least 13 years old to use this App. By using the App, you represent that you meet this age requirement. If you are under 18, you must have the consent of a parent or legal guardian to use the App and agree to these Terms.

3. Account Registration

• You must sign in with an Apple ID or a Google account to use the App.
• You are responsible for maintaining the security of the Apple or Google account you use to sign in.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at [email protected] if you believe your account has been compromised.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of Service

newppearance is a visual exploration tool that uses artificial intelligence to generate simulated images of aesthetic facial changes based on photos you provide.

Important — Not Medical Advice

The App is not a medical device, does not provide medical advice, and simulation results are not predictions of actual surgical outcomes. Results are AI-generated visuals for entertainment and exploratory purposes only. You should always consult a licensed medical professional before making any decisions about cosmetic procedures.

5. Credits and Billing

5.1 Free Credits

New accounts receive a limited number of free simulation credits. Free credits are a one-time lifetime allowance and do not refresh. Simulations generated with free credits include a watermark on saved and shared images.

5.2 Paid Credit Packs

We offer the following one-time, non-refundable consumable credit packs:

• 5 credits — $1.99
• 20 credits — $5.99
• 50 credits — $11.99

Purchased credits never expire. While you have remaining paid credits, saved and shared images are generated without a watermark.

5.3 Billing

• Purchases are billed through your Apple App Store or Google Play account.
• Credit packs are not subscriptions. You are not enrolled in any recurring charge.
• Your account will be charged at the time of purchase.
• Credits are added to your balance immediately upon successful purchase.

5.4 Refunds

• Credit packs are consumable in-app purchases and are generally non-refundable once credits have been used.
• Refund requests are handled by Apple (App Store) or Google (Google Play) in accordance with their respective refund policies. We do not process refunds directly.

5.5 Restore Purchases

Consumable credit packs cannot be restored. Once credits have been delivered to your account, they remain tied to that account and cannot be transferred to another device or account.

5.6 Price Changes

We reserve the right to change credit pack prices. Price changes apply only to future purchases; previously purchased credits are not affected.

6. User Content and Face Photos

• By uploading a face photo, you grant us a limited, temporary license to process that photo solely for the purpose of generating your requested simulation.
• You represent that you have the right to upload any photo you submit — do not upload photos of other people without their explicit consent.
• Your face photos are deleted from our servers within 1 hour of upload.
• We do not claim ownership of your photos. Your photos remain yours.
• Do not upload photos of minors.

7. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose.
• Upload photos of other people without their consent.
• Upload photos of minors.
• Attempt to reverse-engineer, decompile, or hack the App.
• Use automated scripts or bots to access the App.
• Resell, sublicense, or commercially exploit the App or its outputs.
• Use the App to harass, defame, or harm any individual.
• Circumvent purchase restrictions or tamper with credit balances.

8. Intellectual Property

All content within the App — including but not limited to the UI design, illustrations, AI models, and source code — is owned by newppearance or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the App without our written permission.

Simulation results generated by the App are provided for your personal, non-commercial use only.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free.
• Simulation results will be accurate, realistic, or satisfy your expectations.
• The App will meet your specific requirements.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEWPPEARANCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR PERSONAL INJURY ARISING FROM YOUR USE OF THE APP.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we believe you have violated these Terms. You may delete your account at any time from the Settings screen. Upon termination, your right to use the App ceases immediately and we will delete your account data in accordance with our Privacy Policy. Remaining credits on a terminated or deleted account are forfeited and are not refundable.

12. Governing Law and Changes

Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date above. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
